(“Bek Shipping” or “Company”), in the capacity of data controller, we hereby declare that your personal data will, in accordance with the purpose requiring their collection and processing, in connection with, with limitation to and to the extent necessary for this purpose, in the form in which you submitted or they were submitted to our Company, in their correct and up-to-date version, be saved, stored, retained, rearranged, shared with the institutions legally authorized to request these personal data, categorized, sent, transferred to third parties domestically and/or abroad under the conditions provided for in the Law on the Protection of Personal Data, and processed in other ways listed in said Law.

Personal data may be processed to ensure that requests for dry cargo shipping and chartering services can be properly and completely fulfilled, the obligations specified in the legislation can be performed, the person performing the process/having the process performed can be identified, electronic or printed records and documents can be issued, and the information storage, reporting and informing obligations provided for in the legislation can be fulfilled.

Data obtained from you in accordance with the provisions of the Law are used, stored and protected to ensure that you and/or the institutions and organizations you represent can make use of the services provided by the Company, necessary processes are performed including but not limited to setting and implementing the Company’s commercial and business strategies, performing marketing activities, business development and planning activities, administrative operations are performed by the Company with regards to communication, the physical security and supervision of the locations used by the Company is maintained, the Company builds relations with business partners / clients / suppliers, contract requirements are fulfilled and financial reconciliation processes are performed in relation to the products and services provided with business partners, suppliers and other third parties, human resources policies of the Company are implemented, the call center of the Company is called or its website is used, the order placement process is performed, invoices related to orders and maintenance and repair requests are issued, the collection procedure is performed, processes related to your requests for cargo shipping and chartering are managed, the quality of the services provided by the Company is enhanced, management processes of the company are performed, and the services provided by the Company and the quality policy of the Company are improved.

1- Method, Purpose and Principles of Personal Data Collection and Processing

The field of activity of our Company consists of dry cargo shipping, chartering, and activities related to these services. The personal data obtained within the scope of these activities will be processed by our Company in compliance with the legislation. While performing data processing activities, our Company will act in accordance with the principles, purposes and procedures specified in the Law. In relation to the processing of sensitive personal data, BEK Deniz Taşımacılığı A.Ş. takes sufficient measures determined by the Board in addition to those specified in the provisions of the Law on the Protection of Personal Data.

Your personal data may be collected by our Company via telephone, e-mail, other verbal, electronic or written media. In relation to the data processed by automatic systems, BEK Deniz Taşımacılığı A.Ş. will act in accordance with the legislation and its policy text.
Your personal data will be retained for the maximum period that is referred to in the legislation or is necessary for the purpose for which they are processed, and in any case, throughout the legal period of limitation.

2- Your sensitive personal data

As per the Law on the Protection of Personal Data, your data related to your race, ethnic origin, political views, philosophical belief, religious, sectarian or other beliefs, dressing style, association, foundation or union memberships, health, sexual health, criminal convictions and injunctions imposed on you, if any, and your biometric and genetic data are your sensitive data. We advise you not to share your sensitive data in your communications with us as long as we do not request it from you specifically and it is not necessary.

Within this context, if necessary for maintaining the legal and commercial relations between you and Bek Deniz Taşımacılığı Tic. A.Ş., your personal data are used by various departments of the Company in accordance with the purpose of activity of these departments. Your personal data will be retained for the period specified in the relevant legislation or necessary for the purpose for which they are processed, and in any case, throughout the legal period of limitation.

3- Transferring of Personal Data

Your personal data collected by Bek Deniz Taşımacılığı Tic. A.Ş. may be transferred to the persons and institutions below in accordance with the Law on the Protection of Personal Data and other legislation, and to Bek Deniz Taşımacılığı Tic. A.Ş. employees, representatives and/or any natural persons or legal entities residing domestically, public offices and public institutions and organizations and natural persons or legal entities helping with the performance of the services provided by Bek Deniz Taşımacılığı Tic. A.Ş. so that requests for dry cargo shipping and chartering can be fulfilled orally or in writing and invoices can be issued in relation to these requests/services.

The person/organization referred to above, their employees, representatives, themselves or any person acting on behalf them, may request, for purposes including but not limited to individual request, legal investigation, etc., any data of yours transferred to Bek Deniz Taşımacılığı Tic. A.Ş.

4- Sharing of Your Personal Data with Third Parties Abroad

For purposes related to the management of the Company, performance of its business activities and implementation of Company policies, your personal data may be transferred to Microsoft Office applications, cloud solutions and backup systems in countries whose databases have or does not have sufficient protection. Your personal data may be shared with third parties such as companies to which Bek Deniz Taşımacılığı Tic. A.Ş. provides services.

5- About the Security Cameras in the Service Area of Bek Deniz Taşımacılığı Tic. A.Ş.

Within the service area of the Company, video is recorded by the security cameras located at the entrance gates, building exteriors, dining hall, cafeteria, visitors’ waiting room, car park, security cabin and floor corridors to ensure the security of the building, and the recording process is supervised by the security department.

These personal data are automatically processed on the basis of the legal grounds explained in Article 5 of the Law, namely “being necessary for the data controller to perform its legal obligations” and “data processing being necessary for legitimate interests of the data controller, provided that the basic rights and freedoms of the relevant person are not damaged”.

Said personal data may be transferred to judicial authorities or relevant law enforcement officers for settlement of legal disputes or if requested pursuant to the relevant legislation.

6- Rights of the Data Subject Pursuant to Article 11 of the Law on the Protection of Personal Data

Pursuant to Article 11 of the Law on the Protection of Personal Data, the data subject is entitled to apply to our company and
- learn whether personal data belonging to him/her and/or the person who he/she is the legal guardian of have been processed or not,
- request information about processing if they have been processed,
- learn about the purpose of processing and whether the data have been used in accordance with this purpose,
- know the third parties to whom personal data have been transferred domestically or abroad,
- request correction if the data have been processed in an incomplete or wrong way,
- request deletion or destruction of personal data pursuant to the legislation,
- request that the third parties to whom personal data have been transferred be notified of the correction/deletion/destruction processes performed,
- raise an objection against any unfavorable consequences that may result from analysis of data exclusively via automatic systems,
- claim indemnification of the damages arising from processing of data contrary to the Law on the Protection of Personal Data.

Within this scope, data subjects may submit their applications filed for the purposes specified above to Bek Deniz Taşımacılığı Tic. A.Ş. in written form or another form determined by the Personal Data Protection Board, if any. They may apply by sending a reply-paid letter together with their identity documents to Kavacık Mah. Elbistan Sok. No.10 SAS Plaza K:1 D:5 Beykoz/Istanbul.

The written application of the data subject must state the topic of request in a clear and comprehensible way, the topic of request must be related to the data subject himself/herself, or if the data subject is acting on behalf of another person, he/she must be specifically authorized with regard to the matter, and the authorization must be documented.
